GUARANTEE

NOW Technology Systems Pty Ltd, as Trustees for Greenfield Chan Discretionary Trust (trading as SiteDesignNOW.com), guarantees to supply professional web services in accordance with our written proposals and contracts entered into with you, our client.
 
We offer a full 21 day test period after completion of your website. During this period we will make good coding, design and/or administration problems. We provide ongoing free support for coding and website administration problems as part of our monthly hosting service.
 
If for any reason you are not satisfied with our products or services please contact us and we will urgently address any outstanding issues.

HANDOVER OF WEBSITE

NOTE: While generally your website will be completed within five weeks, or less, of confirmation of order, or at a time mutially agreed to in writing. Completion is dependant on the client providing necessary information, including artwork, images, logos, content, domain name access, and third party secure payment details on a timely basis, along with any other relevant informaton requested by the developer.  

On completion of your website we will hand over the website for client review.

Changes or revisions must be advised to NOW Technology Systems by email within 21 days of handover of website.

After the review period, changes requested that fall within the scope of our written engagement quotation, will be undertaken at no extra charge.

There is no time limit or charge for making good coding errors, ommisions, and technical issues which will be dealt with on a high priority basis.

If requested changes or additions do not fall within the scope of our written quotation, NOW Technology Systems reserves the right to charge for any additional work required.

After the 21 day review period, balance of payment on the website must be paid as per the terms of engagement in original quotation, irrespective of any ongoing changes or additions requested by the client.

NOTE: Hosting fees will be charged from the 1st day of the first full month after handover, or within 21 days of handover of the website for first review, whichever comes first.

DISCLAIMER OF WARRANTIES/LIMITATION OF LIABILITY

Whilst we endeavour to provide an accurate, professional service at all times, it is the responsibility of the client to advise by phone or email of any issues or problems affecting their website.

The final responsibility is on the client to ensure website information, content, data and images supplied to NOW Technology Systems Pty Ltd, for placement in the website, is proof read and checked for accuracy during the 21 day handover and testing period, or within 10 days of any upgrades.
 
It is the responsibility of the customer to check phone numbers, addresses, bank account numbers, and other data for accuracy, correctness, omissions, or defects. Corrections will be implemented by NOW Technology Systems Pty Ltd on a no charge basis.
 
Products, such as Web Hosting and Payment Gateways are supplied “as is”, “as available”, without warranties of any kind, either expressed or implied.
 
At no time does NOW Technology Systems Pty Ltd accept liability for direct, indirect, incidental, special, or consequential damages resulting from hacking of our servers, the use of or inability to use any services provided, including mistakes, omissions, interruptions, deletion of files or e-mail, loss of or damage to data, errors, defects, viruses, delays in operation, or transmission, or any failure of performance, whether or not limited to acts of god, communication failure, theft, destruction or unauthorized access to records, programs or services.

INTELLECTUAL PROPERTY

Whilst we recognise client ownership of website content, logos, and banners, please be advised as developers, NOW Technology Systems Pty Ltd, has developed eCommerce systems, and other interactive web applications, and eMail promotion systems. These systems are provided to clients as part of our website development and hosting services. These systems and source code remain the intellectual property of NOW Technology Systems Pty Ltd and are not transferable.

PRIVACY

Your privacy is assured, NOW Technology Systems Pty Ltd does not pass on, sell or exchange information provided to us by clients or prospects. Any such information is limited for use by authorized staff of NOW Technology Systems Pty Ltd to provide you with professional services and products as requested. NOW Technology Systems Pty Ltd, or staff, does not have access to your credit card information at any time.
 
Online forms are stored securely on our servers and can only be accessed by secure password.

SPAM, ILLEGAL USE, OR IMMORAL CONTENT

NOTE: NOW Technology Systems Pty Ltd has a no-tolerance policy towards clients using
go-email.now.com or any of our WEBSITE systems and servers for transmission of SPAM, BREACH OF COPYRIGHT, OR FOR ILLEGAL PURPOSES AS PRESCRIBED UNDER AUSTRALIAN LAW.
 
Non compliance with Australian Anti Spam regulation will result in your account being closed, with no refund of prepaid fees. You can also be charged under the Australian legislation with severe penalties applying.
 
Subscribers must use an opt-in system to add subscribers to their database or have permission from a subscriber to add their name and email address to the database.

Subject to Anit Spam legislation, exceptions may be made where there is a close business/client relationship already established and the intent of your email is to grow the relationship in line with the existing business.
 
Sending email to addresses obtained through commercial mailing lists, email lists harvested from websites and directories, etc is spamming and you will be caught. Fines can be very high even for first time offenders.
 
As a condition of supply of internet services by NOW Technology Systems Pty Ltd and/or its third party associates, clients agree to comply with the laws, policies, regulations, and accepted practice as detailed in the the Australian SPAM ACT 2003 and amendments, in respect to the requirements for commercial emailers.

PAYMENTS AND TERMS

Payment of accounts must be met in strict accordance with your agreement with NOW Technology Systems Pty Ltd as shown on our invoice.

Unless otherwise pre-arranged we invoice at the beginning of each month and payment must be made within 20 days of invoice date.
 
Failure to meet payment commitments without making suitable arrangements with NOW Technology Systems Pty Ltd, may result in disconnection of your website and/or mail marketing and newsletter system, until payments are brought up to date. A re-connection fee of $60.00 + GST will be charged.
 
Payments can be processed by Credit Card or Direct Deposit to our Bank Account.

Remittance advice is provided on the lower half of our invoice, including our bank details.
 
ONLINE PAYMENT can be made in real time using VISA and MasterCard or by direct payment to our bank account (details below).

Credit Card Payments are processed using eWay secure payment gateway accessed on our website by clicking the following link: PAYMENT PAGE
 
Credit card details are entered directly to the eWay internet gateway page using Secure Socket Layer (SSL 3.0 or higher) encryption technology. This site uses firewalls within the system, as well as in front of the payment gateway.
 
At no time do we or any other party, other than authorised payment gateway staff have access to your payment details.

All transactions are conducted securely, in real-time, directly with eWay secure payment gateway.

Charges on your card statement will be identified as NOW Technology Systems Pty Ltd.
